Gardeners Tokyngton Service Terms and Conditions
These Terms and Conditions set out the basis on which gardening services are provided by Gardeners Tokyngton. By making a booking, confirming an appointment, or allowing work to begin, the client agrees to these terms. They are designed to keep the service clear, fair, and professionally managed for both private and commercial customers. In these terms, references to we, us, and our mean the service provider, and references to you and your mean the customer receiving the gardening service.
The purpose of these terms is to explain how bookings are arranged, when payments are due, what happens if a job is cancelled, and how responsibility is shared if something goes wrong. They also explain waste handling rules, which are especially important where green waste, soil, timber, or other garden materials are removed as part of a gardening service. These terms should be read carefully before any work is scheduled.
By using the services of Tokyngton gardeners, you confirm that you are authorised to request the work on the property in question and that you have read and accepted the terms applying to the service. If you do not agree to any part of these terms, you should raise the issue before the booking is confirmed. Once work has been accepted or started, the relevant provisions below will apply.
1. Booking Process
All bookings for Gardening Services Tokyngton are subject to availability and confirmation. A request for work does not create a binding booking until it has been accepted by us, either verbally, in writing, or by electronic confirmation. We may ask for details such as the type of work required, access arrangements, property size, and any special conditions that may affect the job.
Before the service begins, we may provide an estimate based on the information supplied by you. Estimates are not fixed quotes unless clearly stated otherwise. If the actual scope of work changes after inspection or during the visit, we may revise the price to reflect the additional labour, materials, waste handling, or time required. Any significant change will be explained before further work continues wherever reasonably possible.
It is your responsibility to ensure that the service description is accurate when booking gardeners in Tokyngton. This includes disclosing restricted access, protected areas, hidden hazards, or any other condition that may affect safe completion. Where the property requires parking permits, gate codes, or timed access, you must make those arrangements available in advance. Failure to do so may result in delay charges or cancellation fees if the job cannot proceed.
2. Payment Terms
Payment is due in accordance with the arrangement confirmed at the time of booking. Unless otherwise agreed in writing, payment must be made on completion of the work or within the stated invoice period. We may request a deposit for larger, recurring, or seasonal jobs, and any such deposit will be clearly identified before the booking is finalised.
Accepted payment methods may include bank transfer, card payment, or another method agreed in advance. All prices are stated in pounds sterling unless otherwise specified. Where a job is quoted inclusive of materials, the price will only cover those items specifically described. Any extra materials, specialist equipment, or emergency disposal charges requested during the job may be added to the final invoice.
Late payment may result in administration charges or recovery action where permitted by law. If an invoice remains unpaid, we reserve the right to suspend further services until the outstanding balance is cleared. For regular Tokyngton gardening services, we may also withdraw future appointments if there is persistent non-payment or repeated failure to meet agreed payment deadlines.
3. Cancellations, Rescheduling, and Access
You may cancel or reschedule a booking by giving reasonable notice. Where notice is provided sufficiently in advance, no cancellation fee may apply. However, if cancellation occurs after resources have been allocated, staff have already travelled, or materials have been purchased specifically for your job, we may charge a fair fee to recover losses incurred.
We may cancel or delay a booking if weather conditions, health and safety concerns, equipment failure, or other circumstances beyond our control make it impractical or unsafe to proceed. In such cases, we will aim to reschedule at a mutually convenient time. Gardeners Tokyngton will not be liable for losses arising solely from events that are outside reasonable control, provided we take reasonable steps to minimise disruption.
You must ensure clear access to the property and any areas where work is to be carried out. If our team cannot begin work because access is blocked, the site is unsafe, or the agreed instructions are unavailable, the booking may be treated as a late cancellation or an aborted visit. In such cases, the applicable fee may still be charged.
4. Service Standards and Liability
We will provide gardening services with reasonable care and skill, using suitable methods and equipment for the work agreed. However, gardening work can involve living materials, changing weather, and pre-existing conditions that may affect the outcome. For example, turf, plants, hedges, or soil may react unpredictably to pruning, cutting, transplanting, or seasonal conditions. For that reason, results cannot always be guaranteed in every situation.
Our liability is limited to direct losses that are caused by our negligence or breach of contract, and only to the extent permitted by law. We do not accept responsibility for indirect or consequential losses, including loss of profit, loss of business opportunity, or third-party claims not caused by our actions. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
If damage is alleged, you must notify us as soon as reasonably possible and provide a clear description of the issue. We may inspect the matter before deciding whether repair, replacement, or another remedy is appropriate. In many cases, a practical solution such as rework, adjustment, or reimbursement for the affected item may be offered instead of monetary compensation.
5. Waste Regulations and Site Clearance
Where our service includes removal of garden waste, we will handle waste in line with applicable UK waste regulations. This may include green waste such as grass cuttings, hedge trimmings, leaves, branches, roots, soil, and similar organic material. We may also remove packaging or non-organic debris if this has been agreed in advance. Waste must be correctly described at the time of booking so that lawful disposal arrangements can be made.
You agree not to ask us to remove hazardous materials unless we have expressly agreed in writing and are legally permitted to do so. Hazardous items may include asbestos, oils, chemicals, paint, sharp metal, medical waste, contaminated soil, or substances that require specialist handling. If such items are found on site, we may refuse removal, amend the scope of work, or stop work if continuing would be unsafe or unlawful.
All waste transferred for disposal will be managed responsibly. Where a waste carrier registration, transfer note, or other record is required, it may be retained in accordance with legal obligations. By instructing gardeners in Tokyngton, you confirm that the waste presented for collection belongs to you or is otherwise lawfully available for removal. You must not include prohibited materials without prior agreement.
6. Client Responsibilities
You are responsible for ensuring that the property is reasonably safe for work to proceed. This includes keeping pets, children, and vulnerable individuals away from active work areas, securing delicate items, and informing us of hidden hazards such as broken paving, buried cables, unstable structures, or waterlogged ground. If you fail to provide relevant information, we cannot be held liable for issues arising from undisclosed risks.
You also agree to notify us if there are protected plants, wildlife concerns, or planning restrictions affecting the area to be worked on. Certain tasks, such as major cutting, stump removal, or clearance near boundaries, may have legal or practical limits. If you require a specific method to be used, this should be agreed before work begins. Otherwise, we will choose a reasonable method based on the service requested and the condition of the site.
Where our team must enter through shared access points or communal areas, you are responsible for making sure such access is allowed. Any permits, neighbour permissions, or site approvals needed for the work should be arranged by you unless we specifically agree to handle them. This helps ensure a smooth and lawful service from Gardeners Tokyngton.
7. Complaints and Rectification
If you are not satisfied with any part of the service, you should notify us within a reasonable time after completion. Please provide relevant details and, where possible, photographs or a clear explanation of the issue. We will review the matter fairly and may offer a re-visit, adjustment, or another suitable remedy if the concern is found to be valid.
Minor variations in appearance are not necessarily defects, especially where the work involves living plants, varying terrain, or weather-sensitive tasks. A complaint will not automatically mean that payment is withheld. Where the majority of work has been completed properly, payment may still be due for the service delivered. If a genuine error has occurred, we will aim to resolve it promptly and proportionately.
Our aim is to maintain a professional standard across all Tokyngton gardeners appointments. We encourage customers to raise issues early so that they can be addressed efficiently. Delayed complaints may be harder to investigate and may affect the availability of any remedy.
8. Governing Law and General Provisions
These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from the services provided will be subject to the exclusive jurisdiction of the courts of England and Wales, unless another forum is required by mandatory law. Nothing in these terms affects your statutory rights as a consumer, where applicable.
If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue in full force. A failure by us to enforce any right under these terms does not mean that right has been waived. These terms may be updated from time to time, and the version applying to your booking will be the version in force when the booking was confirmed unless otherwise agreed.
By proceeding with a booking for Gardeners Tokyngton, you acknowledge that you have read, understood, and accepted these Terms and Conditions. They are intended to provide a clear legal framework for the service, ensuring that both parties understand their rights and responsibilities before any gardening work begins.
